Proffer.ae Website Terms of Use
(User Agreement)
Terms used: Website Owner, Operator, Website Administration.
Company - Proffer real estate LLC, a brokerage company that manages the Proffer.ae website and provides services for registering real estate purchase and sale transactions.
User - any person using the Website.
Company Partner - a user registered as a real estate agent, who has a Partner Agreement in effect, acting in the interests of the Data Subject to conclude a contract for the purchase and/or sale of real estate through the Proffer.ae website.
Acceptance of the Agreement - full and unconditional acceptance of all the terms of the Agreement by performing actions to Register on the Website.
Personal Data - personal data of the User that the User provides about themselves, or through the Company Partner, during Registration or in the process of using the Website's functionality.
Data - other data that is not related to personal data.
Registration - filling out forms by the User requesting user data, including feedback forms, applications, user accounts.
Website - a website hosted on the Internet. The Website is a resource intended for real estate transactions.
1. Introduction
1.1. This Agreement defines the terms of use of the Website's materials and services by Users.
1.2. This Agreement is a public offer. By starting to use this Website, the User expresses their consent to these Rules in full. If the User disagrees with any of the provisions of the Rules, the User must immediately stop using the Website.
1.3. The Website Administration has the right to unilaterally change the terms of these Rules at any time without any special notice. The current Rules are the Rules posted on the Website.
2. Restrictions on Rights, Obligations and Rights of the User
2.1. The User does not have the right to take actions that violate the current legislation in the field of intellectual property, copyright and related rights, as well as to perform any actions that may lead to disruption of the normal operation of the Website and Website services.
2.2. The User does not have the right to attempt to access the Website's Content and services in any way other than through the interface provided by the Website Administration, as well as to take actions aimed at changing the Website or disrupting its normal operation.
2.3. The use of Website materials without the consent of the copyright holder is not permitted.
2.4. Access to the Website for Users is round-the-clock. Access to the Website may be temporarily suspended in case of a system failure, scheduled maintenance, repairs, or for other reasons.
2.5. The User fully accepts that transactions concluded using the Website are transactions using the services of Proffer real estate LLC as a broker with a commission fee.
2.6. The User, acting on behalf of the Buyer or Seller, reserves the right to unilaterally withdraw from the real estate purchase and sale agreement at any point prior to the payment of the deposit (10% of the property value) without incurring any liability. Should the Partner choose to withdraw from the agreement after the deposit has been paid (10% of the property value), the withdrawing party shall be obligated to compensate the other party with a penalty equivalent to 10% of the property value.
3. Prices (Commission Fee)
3.1. The commission fee is 1% (one percent) of the transaction amount if the User is the Seller of real estate and is charged to the Seller.
3.2. The commission fee is 1% (one percent) of the transaction amount if the User is the Buyer of real estate and is charged to the Buyer.
3.3. The commission fee is set by the User if the User is a Buyer's agent (Company Partner) and is charged to the Buyer.
3.4. The commission fee is set by the User if the User is a Seller's agent (Company Partner) and is charged to the Seller.
3.5. The commission fee is distributed between Proffer real estate LLC and the Company Partner according to the Partner Agreement, published here.
4. Responsibility
4.1. Processing of personal data is carried outby the Website Administration in accordance with the Policy on the processing of personal data, published here.
4.2. The Website Administration takes all measures to protect personal data.
4.3. The Website Administration is not responsible for any kind of losses or damages that may arise in connection with viruses or the actions of the Users themselves.
4.4. All possible disputes arising from this Agreement or related to it are subject to resolution in accordance with the current legislation.
